When it comes to serving divorce forms, there is a basic rule than when you serve certain forms on your spouse, you have to include blank forms for them to use to respond.

For instance.  Lets say you file a motion asking for Spousal Support.  When you file the request for order for Spousal Support you also need to file and Income and Expense Declaration.  You will also have to serve blank copies of each of those forms as well.

When you serve a motion to request orders on your spouse, you will also have to serve a blank “Response” form.  In addition, you will also have to serve your spouse a blank income and expense declaration.

Make sure when you file your proof of service that you indicate that both those blank forms were served along with the motion and your income and expense declaration.

Another example is when you first file for divorce.  You file your Summons and Petition.   When you serve the Summons and Petition, you also have to serve a blank Response to divorce form.

There are only a few exceptions where this will not be the case.

I spent this weekend preparing multiple divorce judgments and thought I would talk about the Property Order Attachment To Judgment, Form FL-343 which you can use to divide up your community and separate property assets and debts.

This form is used as an attachment to your divorce judgment and allows you to easily divide up your assets and debts.  The first part of the form has you dividing up your community property assets.  So you would only put those assets that are community property and tell the court what assets the Petitioner is getting and what assets the Respondent is getting.  Make sure not to include any separate assets in the community property section.

The next section deals with division of your community property debts.  Here you would list all community property debts and who they were going to be assigned to.  You will do the same thing here as you did with the community assets, only these will be the debts.

Separate property is the next section.  You will detail what assets and debts will be confirmed as the sole and separate property of the Petitioner and do the same thing for the Respondent.

The FL-345 also addresses other property such as pensions and real estate.

When you are preparing your final divorce judgment paperwork you will simply include the Property Order Attachment To Judgment, Form FL-345 as an attachment to the judgment.  Make sure to complete the divorce judgment correctly, otherwise you risk having your Santa Clarita divorce judgment rejected.
